RHOBH: Erika Girardi, Tom Girardi’s assets frozen after court today

Tom Girardi and The Real Housewives of Beverly Hills star, Erika Girardi, had their community property and bank accounts frozen today in court.

Tom Girardi, husband of The Real Housewives of Beverly Hills star Erika Girardi, was due in court today over charges of embezzling money.  Tom and Erika are being accused of misusing funds meant for families of victims of a plane crash to pay for their own extravagant lives.  According to Law.com, U.S. District Judge Thomas Durkin found that Tom and Girardi Keese were not able to produce evidence that $2 million was not given to the families it was meant for.

Attorney Ronald Richards was present for the hearing and live-tweeted what was happening.  There are apparently four families that were to be paid with the missing money and Tom’s firm is unable to pay.  When he phoned in for the hearing today, it was noted that Tom’s firm only had $15,000 and was unable to make payroll by his lawyer, Evan Jenness.  Judge Durkin ordered that all of Tom and the law firm’s assets be frozen while they investigate further.  He is holding him in civil contempt, chastising him for taking money from “widows” and “orphans.”

Judge Durkin requested a list of all of the Boeing clients that have been paid and the rest of the clients that have not been paid.  There is apparently a fifth family that has not been paid.  Edelson PC, the firm working for the families, is apparently working without payment and just wants to get the other families paid.  They also claim that Tom offered money to make this go away before it got to court.

If the money has been misused like they say it has, there’s a good chance Tom will be disbarred.  It sounds like they asked for leniency because Tom is not fully mentally competent, but that is to be determined.  If he is deemed competent, he could be facing criminal charges.  “When people get money from Boeing in a trust and don’t keep it in trust and spend it other ways, it’s a serious ethical violation, probably illegal,” Durkin said.  A request for a mental evaluation was granted.

It sounds like Tom, Erika, and Girardi Keese are in some serious trouble.  Meanwhile, Erika is still acting aloof and vain on social media.  Someone should tell her it’s time to hide in a hole now.
