Erika Jayne: Tom Girardi officially under temporary conservatorship

While Erika Jayne is off filming beach lunch events for The Real Housewives of Beverly Hills, her estranged husband is not doing well.  Many of us have heard the term “conservatorship” before in reference to Britney Spears.  She has been under an involuntary conservatorship for more than a decade now, unable to make decisions, financial or otherwise, for herself.

In the wake of the Tom Girardi fraud case, a judge appointed Tom’s brother, Robert Girardi, to be his temporary conservator for the time being.  This will only last through Mar. 30, but ensures that Tom does not need to be in court due to his unknown medical issues.

Anthony Cosio has been named as the official Court Appointed Counsel (CAC) presiding over the temporary conservatorship.  The report, provided by Attorney Ronald Richards, notes the following:

"“It was CAC’s conclusion that Thomas could not fully comprehend the nature of the proceedings although he did state that he had no objections to Robert taking care of him for the limited purpose of executing contracts on his behalf. Thomas voiced his concern of having a media circus at the hearing. He indicated that he wanted to continue the matter for thirty days as he was currently having tests performed to diagnose any memory issues.”"

It was noted that Tom needs help from someone, i.e. Robert, to help with the managing of his financial and personal affairs.  It is interesting to note that Tom is coherent enough to realize there is the potential for a media circus, but not coherent enough to take care of it himself.

We keep hearing that Tom is undergoing tests of some kind to determine if he is mentally sound, but we have received no results to confirm or deny it yet.  Instead, they are just pushing the idea that Tom simply cannot care for himself.  “The Proposed Conservator is requesting Thomas be adjudged to lack capacity to: provide for temporary care, maintenance, and support, and protect property from loss or injury.”

As of court today, it sounds like the bankruptcy case is full speed ahead regardless of Tom’s conservatorship.  Another court date is set for Mar. 15 in which we will hopefully get more news on what’s next for Hollywood’s newest fraudulent couple.
