Erika Jayne: Does Tom Girardi have “pretend amnesia” now?

Tom Girardi, husband of RHOBH’s Erika Jayne, claims he is mentally incompetent to answer to the claims against them…but is that the case?

A new day, a new update in the case against Erika Jayne’s husband, Tom Girardi.  Edelson PC has filed a motion to oppose having Robert Girardi as Tom’s guardian.  The company claims that throughout their correspondence before the case was filed, they felt it was clear that Tom knew exactly what he was doing.  What he was doing was essentially a form of a Ponzi scheme, using money collected from one client to pay off another client and/or debtor.  The Real Housewives of Beverly Hills star remains quiet besides posting multiple photos of herself a day.  

The declaration reads, “His communications with us in the months before we filed our show cause motion were calculated to further.”  Tom was well aware of the facts on each case and was able to postpone the inevitable by offering just enough information to get by, but not enough information to actually propose action.  I take from these conversations that Mr. Girardi was well aware of what he was doing, and that it was wrong.”

As usual, Attorney Ronald Richards has been reporting on the incidents and has a copy of the testimony on his Twitter.  It seems Richards thinks Judge Russell will not be having any of this nonsense in his court.

The complaint reads, “After we filed our motion, Mr. Girardi continued to contact the firm, in an apparent effort to resolve the matter without a contempt proceeding.  The communications, which occurred in December 2020, further showed that Mr. Girardi understood the nature and consequences of his actions.”  Also, Tom was coherent enough to ask how much each client was owed and even offered excuses for why they had not been paid.  He doesn’t sound mentally incompetent to us.

If you recall, back during season 8, episode 13, Erika and Teddi Mellencamp Arroyave got into quite the argument about nothing.  Teddi said Erika said something, Erika was INSISTENT that she did not say it.  The footage clearly shows Erika saying it as the pair walked up the stairs.  When Teddi commented that Erika had pretend amnesia, she flipped her lid at the table.

“No sweetie don’t ever say that I’m pretending, I’m not pretending.  I’m telling you the truth.  I don’t remember saying that.  Don’t ever, ever do that to me.”  Erika was always one to deny, deny, deny, so we suppose this behavior isn’t shocking coming from Tom himself.

But how long can this go on for?  It seems clear that Tom was well aware of what he was doing.  It will take a while for all of this to shake out, but it seems Tom and Erika will have to face the terrible dance music soon enough.
